Terms & Conditions

In using this website and as a direct client of Mensos Concierge (Mensos Ltd), you are deemed to have read and agreed to the following terms and conditions:

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions when booking direct with Mensos Ltd. “The Company”, “Ourselves”, “We” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Limits of Responsibility

We, our employees, directors and agents do not own or operate any entity which is to or does provide goods or services for your trip. We purchase transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurants, ground handling, excursions and other services from various independent suppliers. All such persons and entities are independent contractors. As a result we are not liable for any negligent or wilful act of any such person or entity or of any third person.

Travel related services including purchasing travel tickets, holiday packages and affiliated arrangements made through Mensos Ltd will be subject to the Terms & Conditions of the travel company or supplier, if appropriate. Mensos Ltd is not an authorised travel agent and purely acts as an introductory company. Although Mensos Ltd will carefully check exactly what is required in terms of personal documents prior to clients’ travel, it is wholly the responsibility of the client and each guest to ensure they have the correct travel insurance, visa application confirmation and associated travel documentation prior to travel. Clients of Mensos Ltd agree that any contract entered into between themselves and an independent supplier is not the responsibility of Mensos Ltd.  Mensos Ltd urges clients to carefully read the Cancellation policy and Terms & Conditions for each supplier.

We act solely as agents with respect to all transportation, hotel and other trip arrangements. In that capacity, we exercise all reasonable care possible to ensure the traveller’s safety and satisfaction, but we neither assume nor bear any responsibility or liability for any injury, death, damage, loss, accident, delay, or irregularity arising in connection with the services of any airplane, train, ship, automobile, motor coach, carriage, or other conveyance, or the actions of any third-party involved in carrying the traveller or in affecting these trips, including without limitation, any activities associated with such trips. The terms and conditions of the supplier apply to your contract. Suppliers provide their Services in accordance with their own terms and conditions and some of these terms and conditions may limit or exclude the supplier’s liability to you.

We invite our clients to place enquiries via e-mail, WhatsApp or telephone. All requests must be ethical, lawful and decent. Although every attempt is made to fulfill each request, if a request cannot be fulfilled, an alternative will be offered and you as our client will be informed as soon as possible. A supplier or service provider will expect our clients to abide by their own Terms & Conditions.

Insurance

Travel insurance is essential and it is a condition of booking that you and all members of your party must have in place, adequate personal travel insurance to ensure that the insurance cover you purchase is adequate for your particular needs. No liability will be accepted for anyone travelling without adequate travel insurance.

Travel Advisories / Warnings

It is your responsibility to inform yourself about the most current travel advisories and warnings by referring to The Foreign and Commonwealth travel unit at www.fco.gov.uk. You assume all risk of personal injury, death or property damage that may arise out of the events advised or warned against.

*Coronavirus

With the spread of Coronavirus (COVID-19), Mensos Ltd are aware that a number of guests are concerned about how safe it is to travel or continue to book future travel without the guarantee of some protection.

We are closely monitoring the situation and the safety of our guests are of paramount importance. If the World Health Organisation / FCO were to issue a travel ban for your holiday destination, then it is likely (although not guaranteed) that the hotel would amend their T&C’s to allow you to change your dates to another trip to be taken in 2020. However, the airline / hotel / Mensos Ltd are under no obligation to refund the trip or offer compensation if you were to cancel as the reason for the holiday not going ahead is out of our control. 

You must have Comprehensive Travel Insurance in place at the time of booking your trip that will cover you for any changes or additional costs to your holiday. Make sure that your insurance stipulates to cover any Covid-19 associated costs or losses.

Liability

Our liability for losses you suffer as a result of us breaking this agreement including deliberate breaches is strictly limited to the purchase price of the trip you purchased and paid for and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your booking is accepted by us.

This does not include or limit in any way our liability:

  1. for death or personal injury caused by our negligence;
  2. for fraud or fraudulent misrepresentation; or
  3. for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

Disclaimer

The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, this Company:

  • excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature; and
  • excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

None of your statutory rights as a consumer are affected. 

Payment

All major Credit/Debit Cards and BACS Transfers are all acceptable methods of payment. Our Terms are payment in full within thirty days unless otherwise specified. All goods remain the property of the Company until paid for in full. Monies that remains outstanding by the due date will incur late payment interest at the rate of 2% above the prevailing Bank of England’s base rate on the outstanding balance until such time as the balance is paid in full and final settlement. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed £3,000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

We do not store Credit Card details. Should our clients entrust Mensos Concierge with their Credit or Debit Card details to complete a request transaction, they must be aware that although every attempt will be made to keep these details secure, Mensos Concierge will accept no responsibility for lost or stolen payment cards whilst in the company’s charge.

Cancellation by you

Please note the cancellation conditions sent to you at the time of booking. Cancellation must be received by telephone and confirmed in writing by email at info@mensosconcierge.co.uk, Tel+44 (0)7812 381 786. Your cancellation is effective by email on the day it was sent. However if cancellation is received to us within the cancellation conditions of the restaurant, hotel, operator and/or transport agent you will incur the necessary fees. If you have cancelled before the conditions of the operator you will receive a full refund less £25 administration charge.

Cancellation by us

We aim to provide your product as booked. While we will endeavour to avoid changes and cancellations, we reserve the right to cancel your trip, make alterations in the itinerary to accommodation, transportation, arranged activities, as a result of unforeseen circumstances that arise beyond our control. This is also due to availability at the time of booking.

We will advise you of any changes at the earliest opportunity but if a major change does occur, you have the choice of either, accepting the change of arrangements, accepting an offer of a replacement trip from us of equivalent or closely similar standard and price or accepting a full refund of all monies paid. A major change includes the following changes when made before departure: a change of accommodation to that of a lower rating or standard, an alteration to your scheduled departure time of twelve hours or more, a change of UK departure point to one which is more inconvenient for you (excluding a change of London Airports). We reserve the right to cancel your trip and provide no refund or payments for costs resulting from termination if you or any member of your group behave in a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property.

Termination of Agreements and Refunds Policy

Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be refunded.

Copyright and other relevant intellectual property rights exists on all text relating to the Company’s services and the full content of this website. This Company’s logo is a registered trademark of this Company in the United Kingdom and other countries.

Communication

We have several different e-mail addresses for different queries. These, & other contact information, can be found on our Contact Us link on our website or via Company literature or via the Company’s stated telephone numbers. This company is in England and Wales, registered office The White House, Iping Road, Milland, Hampshire GU30 7NA.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Notification of Changes

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our web site 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis.

These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
